What type of charges am IO entitled to reclaim?

I am in the process of trying to reclaim my bank charges, can anyone help me as to which charges I can reclaim. My bank charges me £35 for going overdrawn, plus a £28 unautorised overdraft fee, making each charge £63. Can I claim them both back or just one or the other?

I am aware that there is a decision in the pipeline but just wanted to get the ball rolling in case it goes in our favour.

Many thanks, S.S.O

    Both of them.
The decision in the pipeline currently is about whether the charges can be assessed for fairness and not if the charges are fair so it will make no difference to refunds when the next judgement comes.

  • Thank you for the advice. Does this mean there will not be a statutory refund after the decision? What will happen after this and is it still worthwhil to persue while it is pending?

The next decision dictates the next stage of the case. No refunds immediately after the decision if the OFT wins but we will be a lot closer to them.
