Company Cars (handing them back)

I'm about to change job; currently have a company car; new job doesn't have a company car. Current company want me to finish on 9th June but I've got 2 weeks holiday entitlemet so last 'working' day will actually be 26th May.

Am I entitled to keep the company car during my two weeks holiday until 9th June?

  • You need to check your contract of employment which you'd have signed when you started - there should be clauses in there covering expectations on both sides should you resign. and which may have specific rules in place if you are leaving to go and work for a competitor of theirs (in which case you may have to forfeit your 'perks' at a date they stipulate).

    Generally:
    Holiday entitlement outstanding is usually calculated pro-rata to the point in the holiday year at which leave, for instance if you have 4 weeks paid holiday per calendar year (1st Jan - 31st Dec) and you leave within the first quarter, you'd only amass c 5-7 days of accrued holiday in that period, depending on how your own employer calculates their holiday accruals.

    If the company have asked you to leave on 9th there must be a reason (i.e. that is when your 1mth notice period ends, if you resigned c 9th May). If that is the case you should work your accrued untaken holiday within that notice period (i.e. make your finish date 2 weeks earlier than 9th June..result!), rather than expect your employer to effectively extend your notice period in your contract by the number of days or weeks you feel you are owed.

    if your resigned c. 9th May and you have to give 1mths notice, then your employer would probably have informed the leasing co' (or whoever owns the car) that your contract will end 1mth from that date. Theya re probaly within their rights to reallocate it to another driver from the 10th June as your notice period should have ended by that date.

    I would say yes you are employed until 9 June whether on holiday or not. Your contract obviously includes a company car, so you keep it until then.

    Incidently I recently changed jobs within the same corporate group. First job inc. co. car second job didn't and I had 8 week trial period, my company let me keep the car until the trial was up. My other option was redundancy.
    I have a cunning plan!
