Land Registry Problems

about 20yrs ago, we sold off part of our land, and a house was subsequently built on it

now i am trying to sell my house, my solicitor is saying the sale of the land isnt detailed at the land registry and i now have to have my property plotted out, to show the true boundarys at a cost of C£500

but, i cannot see that it wasnt registered, as the house that was built on the land has sold about 3 times since it was built, so im sure that this would have been brought up on those occasions.

my only thought is that perhaps the plot of land was registered, but the plot that my house is on, wasnt registered as now being smaller??

So whose fault could this be? im thinking that as i paid a solicitor to handle the sale of the land and all associated paperwork, then he should now be footing the bill for the surveyor? ive looked back through all the old paperwork, and its not very detailed, its basically just an invoice saying 'for work involved in the sale of land' and then the price i paid

if selling land, would you normally expect the solicitor to register both the sold and existing plot, or would they only do work pertaining to the sold land, unless you specifically asked them to register your plot too?

also where can i find out what the land registry is showing as to what land i own? Their website says they hold nothing electronically for the plot, but they might have something in the manual files? also is there anywhere local i can go to view the info, local council planning dept?

Any ideas?

    Hi,

    If you sell of part of an unregistered title, only the part sold off is usually registered.

    Now you are selling yours, the new owners would be responsible to have the property registered.

    It should be a simple matter as it would be th eland in the original deed, minus the land in the sale off deed.

    The land registry will charge a fee for the service based on the value of the property.

    As to a plan, are there no plans in your current deed, how is the property referred to?

    You could obtain an official copy of the adjoining title, the sold off land, and use that to show the land that is now being sold.

    go to the land registry site https://www.landregistry.co.uk (i think!) and for £2 each you can buy a Title Plan of your address and the other plot. It did not used to be compulsory to register property/land. I bought my house in 1989 and it was not registered until last year when i re-mortgaged. Your old solicior may well have conducted the original conveyance according to custom at that time and may not be to blame.
