CPW Contract but faulty phone

Evening

A friends of my has an 18 month contract on a touch screen Samsung phone.

In the past 5 months the phone has died twice (one was software, the other I don't know), the most recent of these last week.

He went into CPW and said he wasn't happy with the phone, had lost faith in the product and would like to amend his contract to move it to a different phone. CPW said they couldn't do this as the contract was with O2 and not them (even though they provide it) and they are entitled to repair the phone 4 times before they replace it with the same phone.

Can CPW claim this as said? Does it go against SoGA? Anyone work for the !!!!!house able to comment?
