Item broke after 1 hour?

I bought my daughter some boots and today she wore them for the first time. By lunchtime the zip had broken on them, in that the zip 'teeth' separated from the bottom.

Luckily she had her pumps at school in her pe kit. I have contacted the seller who has said they can't return them to the manufacturer now as they have been worn but that they will refund me £3 to get the zip repaired.

I'm not happy at this as it would cost more than that but its more the principal.

what is my best course of action?

    I assume they were new off a business seller ? If so then the distance selling regulations should apply - you should get a full refund if the item is returned. Any decent seller will refund return postage.

    Hi and thanks for replying. No, she is a private seller but has sold lots of pairs of these boots and others. I guess she buys in bulk?

    Open a SNAD in paypal. If she is buying to sell she is a business which both ebay and HMRC may be interested in

    So she is really a business masquerading as a private seller.
    If the seller is not willing to co-operate then open an item-not-as-described dispute with paypal or ebay (I think you can do it with ebay these days). The worse that can happen is you lose your return postage cost.

    Try and communicate some more with the seller but if that fails you will be asked to return the item by paypal. Make sure you do send it recorded or you will lose out.
  • Open the dispute, it makes no real differance whether shes a bussiness or a private seller either way you will get your money back, maybe short your return postage.... but yes, make sure you send it by 'traceable' means
