Claiming back cc charges/ delaying tactics

Hi all,

Thanks to help on here (mainly natweststaffmember - thank you as always!) - I wrote off to Cap1, Debenhams and House of Fraser last month for my SAR.

Got my lists of charges from HoF and Debs - sent off the second letter and now I've received a letter from both, saying they are looking into my complaint and will try to come back to me within 4 weeks.

The same happened with my hardship claim for A&L and they did that 3 times before rejecting me, so about 16 weeks in total. As they're all Santander, can I assume this is their standard delaying tactic and basically don't hold my breath?

Are there any other letters I can write that will speed them up, or best to leave them to it?

Cap1 cashed my cheque last week so hopefully will get my charges list from them soon..

    How much do they owe you?
    I would let them have this one but remember it's 56 days before you can go to the FOS or if you are going to take this to court then send letter 3 and then if no response sue them in court.

    I think HoF is £130 and Debs nearly £200. I know it's not thousands but still a lot to me. Will leave it until 56 days then..

    Me again (!)

    Still no word from Cap 1, however both Debs and HoF have come back with a £6 refund each respectively!

    They say that only 2 of the charges were £15 so they have refunded £3 in each case to take it down to £12 which the OFT say is fair and that's a goodwill gesture.

    Can I appeal further for all the £12 charges? I did originally but they're basically saying no..

    NWS, I've seen your comments on similar issues and will borrow bluemoo2's letter wording about the OFT saying £12 is a threshold not a target etc and see what they say.

    Says they've already stated their final position on the matter and that position remains unchanged. "As we are now in a state of deadlock, we will not enter into any further correspondence in this matter"..

    What next?! I do owe both a balance, and am paying back monthly but the charges back would go a long way to helping clear that balance.

    Tell them that to avoid further costs of litigating you are prepared to settle for(include the total amount and interest) otherwise you will take them to the County Court and reclaim the charges and will make the judge aware that you have given them ample opportunity to settle the case. Should they settle after the case has been filed at County Court then you will ask for wasted costs based on the letter you have sent.
    I think you need to send it recorded delivery and I think you need to make them aware that the 14 days commences on the date they receive the letter and no further warnings will be given by you.
    You need to follow through as well.

    Thanks NWS, but I'm thinking of going to the FOS instead as can't afford to lay out for court costs, even if I'm pretty sure I'll get them back later.

    If I do go to the FOS, do I need to notify them of that, or just pass on to FOS? And what is the likelihood of the FOS making them pay back my £12 charges - as that's all that's left ?
