    Just a quick update on this -

    I filed my complaint about the mortgage single premium PPI with the FOS and after only 4 months heard last week that the adjudicator had decided to uphold my complaint. However, the company have ignored the adjudicator's request to reimburse us and as a result it will now have to go before an ombudsman, at which point the final outcome could be reversed:mad:

    Regarding the charges, I have filed a complaint with the FLA, who have at this stage acknowledged my complaint and are in the process of contacting Swift. I have also notified the FSA and OFT who, whilst I realise cannot investigate individual complaints, were interested to hear of my experiences.

  • Thanks Di - the adjudicator said it will be passed to an ombudsman after 21st December, but just how long after who knows - they must be sooooo busy!

    I will update when I have further news.....in the meantime hope you have a Merry Christmas:rudolf:

    Hi guys,

    Just to report that having had my complaint upheld by an FOS adjudicator last year but ignored by Norton, last week I heard that the ombudsman assigned to investigate had upheld my complaint!

    Having now signed the acceptance form this is legally binding on both myself and Norton. The FOS say payment could take up to 12 weeks but that if nothing has been heard from Norton within 4 weeks to let them (the FOS, that is) know.

    Despite this victory I still have a feeling that Norton will play hard to get and it might require a court to enforce this, but nonetheless I feel much happier that someone even remotely connected with Swift is being forced to cough up!

    Will report back once cheque has (hopefully) been received and has cleared.

    You can report them to the FSA if they do this. Whilst the FSA dont get involved in complaints, they are more interested in rule breaches. They can actually fine and de licence a company for not following an FOS ruling. Currently, the FSA is focusing on the complaints process at large firms and banks.

    Hopefully it won't come to that, but at least I'll be prepared if it does!

    I'm also quite concerned that if Norton do cough up, they will try to get away with paying less than is due. My mortgage redemption statement made no mention of a partial PPI rebate so I don't believe there was one. Also looking at the paperwork I received in my SAR if there had been a partial PPI rebate as the mortgage was settled early, it would only have been a tiny proportion of the single premium.

    I have done my calculations and think I know how much my refund should be including interest, but I just wish the FOS would make the firm provide the figures before the acceptance form is signed. Whilst they say they will re-investigate if you are not happy with the sum received, having already been down that route with MBNA I found the FOS really only willing to side with the bank once they have closed the complaint file :(

    Hi all,

    Just reporting a further update on this - within the four weeks which the FOS said a response should be received from Norton a letter arrived stating their intention to arrange a settlement payment in accordance with the final decision of the FOS. However, to process the settlement they need figures from Swift regarding the payments/interest made on the PPI so an authority form was enclosed to sign giving them permission to discuss this with Swift. This has been duly signed and returned. They estimate 6-8 weeks before they are in a position to forward details of the settlement they proppose to make. Will update when anything more is heard.

    Just read through this - can someone explain why this mortgage was 'unregulated'? As far as I was aware everything was covered under MCOB from cirica 2004 onwards. Am i missing something?
