Parking Ticket £160

Hi guys, wondering if maybe you could help!!!

I got a parking ticket on the 31/03/09 i spotted a warden and asked he said send the display ticket to hackney council. Silly me just sent the parking ticket and the diplay ticket ONLY.

I made representation on the 20/04/09 of which i included a ticket i diplayed in my window which went unspotted by the parking warden.

I never heard anything back until 20/08/09 which stated i had not responded and neeeed to pay £120.

I phoned Hackney Council and said i have sent representation why have i not heard back? they said they dont know and they will sort it.

On the 28/09/09 i receive a letter claiming i need to now pay £180 i have been on the phone to hackney council and they now tell me i did not included my address in the representation and they could not send out a rejection letter?

Who is in the wrong what the best thing for me to do?:confused:

This is going to seem harsh but it is not.

You have been badly advised (some would say defrauded) the council and you have trusted them.
I cannot see any easy way out for you as it seems the NTO has been and gone and you did receive all the documents but failed to respond in the statutory manner.
I know that you acted based on the 'advice' give by the council and that my words bring you no relief. For that i am truly sorry.

The lessons to be learned are to never deal with any issue that involves such a liability over the phone; Do not trust what you are told by the other party when they have a vested interest in you failing to comply to the regulations - in other words it is not wise to trust the council.

I fear you will have to pay .

This story disgusts me by which I refer to the actions of this council.

On this occasion I am happy to disagree with 'cris'.

This boils down to the fact that Hackney have failed to respond to your appeal - so long as that was the formal appeal, in response to the Notice to Owner.

We need to establish whether there is an actual requirement for you to include your address or not. (They already have it -- or how did they send the NtO?).

There is a further course of action you can take if we can show that Hackney are at fault so far.

You need to take this to 'PePiPoo' forums on the matter of the 'missing address' for starters. You also need to explain exactly what detail you did include in your appeal -- i.e. PCN number???

    Neil,
It the 'advice' received from the council that disgusts me.

    Cris.
