Car illegally lifted by crooked Traffic Wardens

I was wondering if anyone can give me some advice. In July 2008 I parked my car in a main road which had legal parking till 4pm in Glasgow. I returned to the spot at 4.05pm to find the car missing. I immediately sustpected it had been uplifted by the police. I returned home by underground and called my local police station they said they did not lift the car. I was then given the name of the Pound in Glasgow which I called about 4.30pm they said they had not lifted my car and the car was assumed stolen. At about 6pm that night the police searched the area for my car and did not find it my brother also searched for it and there was not sign of it. However, the next day I received a call from the police saying the car was in the Pound as it was lifted due to it been illegally parked. I called the Pound and they told me the car was given a ticket at 4.58pm the previous day followed by another ticket the next day at 9.30pm and it was then uplifted. I challenged this saying the car was not sighted on that street after 3.40pm the previous day. The police however, refused to listen and told me they had photographic evidence of me going in and moving the car around. I was charged with wasting police time. I also had to pay a fortune to get the car back. However, after waiting a year the case did not go to court. I called by Procurator Fiscal and was told the case was not going to court due to lack of evidence. Which clearly means the council and police lied. I have lodged a official complaint about the officer concerned. Could someone please tell me how I can try to recover my money from the council as the car was obviously lifted illegally probably before 4pm and then covered up to save their butts.

    so who did uplift the car and surely proof of time has to be provided? How could this be colluded?

    Sounds like a routine Council removal.

    If so, then OP was detracted from the necessary action by discussing it with the Police - and getting in trouble.

    Correct action would have been to challenge the removal and PCNs through the normal available Council channels.

    Having apparently failed to do so, there is no longer any avenue open.

    Thought I might give you all a update on what is happenning regarding my car getting illegally uplifted a Police Inspector came to visit me and adviced me to get a copy of all the documents that would have been used against me in court using the Freedom of Information Act. This will give me a copy of any photographs the police alleged to have. He also told me I was charged with trying to get out of paying a parking fine hahahaha the car was reported missing at 4.51pm from my home and had a ticket issued at 4.58pm how would the motiff be to get out of paying a parking fine. He also suggested maybe I reported the car stolen to get a insurance claim get real if I wanted to make a insurance claim the car will be dumped miles away not 5 minutes away from my house sucurely locked. He then said I have the right to ask the council to provide proof of when the car was removed eg the Pound has CCTV which would have recorded what time it was brought in. Great stuff I will continue to pursue and try to get a refund even if it means going to the Small Claims Court but maybe we should get rid of the Police Force and everyone should start doing their own detective work.

    You are now saying you reported your car missing from your home .Could that be where the confusion lies?

    I read it like you were saying it was stolen from your home,but you meant you reported it AT home..I think..

    The car was parked outside a branch of the Abbey National on a main road where there is free parking between 9.30am and 4pm. I returned to the spot where I parked at approxiately 4.05pm and the car was missing. I searched up and down the street then took the underground home. When I returned home I made a call to the council and the police who both denied having the car. It was then logged as a stolen car. But the next day the police said the council recoverd the car that morning and it had received 2 tickets one the day I parked it and the following the next day where it was then uplifted.

    The person you need to contact is Paul Watters of the AA.He is the one who gets involved in policy and stuff.I will try to find you a link.I think he would be very interested in this.

    If what you think has happened is true, it is outrageous,there should be safeguards to stop it happening,and a papertrail to prove if it has.

    There will be a log of your call to the police at 4.51.
    You could ring them and ask for the "CAD" reference number.Which may also link to the original crime number.
