Court papers from loan, any help plz!

Hello everyone,
I am really in need of some help asap, i,ve stuck my head in the sand and now i,ve got court papers demanding the whole amount of 9187.13.... i,ve been paying for a year and its still the same amount now. I lost my job in february and told the company my situation. They agreed a payment lowered but I never got the direct debit set up. I have tried to claim on the insurance I took out with the loan as aadvised and they won,t help me either, so whats the point in that? Had a terrible few months with personal probs so forgot about it. Then I wrote to them and asked to stop the insurance as it was increasing the bill and to send a payment book where I could pay something every week. I never got a reply and now I have a form from the courts and i dont know what to do..... i cant pay it and I cant ruin my credit rating as hubby will find out and he is considering business plans and loans. Please can someone tell me what to do????? :-(

    It sounds to me like your credit rating will already be trashed, You will be in default at least.

    It sounds to me your payment protection was missold, that is worth pursuing as it could amount to a good few quid

    Can you advise me on what I should do with this form from the courts as only have 7 days to reply???
    How can I be mis sold insurance and what do I do about that?

    You need to expain a bit more about the form, what is it asking for ?

    it its the claim form from the bulk processing center, first of all file online using the request further time which gives you an extra 14 days. You will need to file a defence dont admit to the debt, say that you are contesting the miss sold ppi etc

    The form is from solicitors and black horse demanding full payment of nearly £9000 because of default in payment.
    I,ve been paying £50 or £60 a week until March. I contacted them but they never replied and the insurance I was advised to take out won,t pay. The loan is the same amount nearly as I when I took it out which I dont understand.
    How can I claim about the insurance if it has gone to court? I thought once this far then I,ve lost..... sorry I,m not very good with this.
  • I,ve just done as recommended and filled out the online form stating I need extra time and I intend to defend. Hope this was right. Now can someone help me with what I should do next please?

    I agree with Treadmill, your credit rating will already be ruined. You need to speak to your husband, it would be better for him to find out from you.

  • It was declined by 1 being self employed and 2 not being able to have the job centre give them some information weekly, I don,t have any of this in writing its all by phone... for some reason neither black horse or the insurance write replying letters.
    I,ve paid for a company to see my credit file and it doesnt look good now beacuse of the defaults etc. I really can,t tell my husband because he would not speak to me for months and would never forgive me. I have never asked a penny off him until recently so its my own doing and my own fault.
    The loan was the second with black horse, paid last 1 no problem couple of years before. This 1 I had to go into the office to sign the agreement and the woman had a £7500 agreement ready for me as such a better offer then the £5000 I had applied for, she encouraged me to take out the insurance saying I would be protected. A year later I lost my job. I have tried contacting Black horse to pay lower payments but they never sent the direct debit for reduced payments, said insurance was done to them and no reply to my last letter. Just this court paper demanding full payment which is nearly the same as when I started after a year of paying.

    two things here then for your claim form, 1, you were self employed so would not of been able to claim on the ppi. 2, you applied for £5000 and they encouraged you to take the extra borrowing out using preasure so put it.

    Black horse can be tricky people, the fos wouldnt get involved with court action pending. Now Im young but one thing I have learnt is you always stand by your partner no matter what and as many others will confirm if you dont say and he finds out he may of been able to help you.
  • I,ve done the online acknowledge of service asking for time. So when do I state what you say? Surely the court will say its my fault anyway? and if I state the issues I have they,ll just make me pay what Black horse are demanding?
    Also what is an fo you mention?
    And yes I agree about what you say re partners but I,ve taken a loan out without him knowing, he,ll not forgive me, my fault and I know now. He wouldnt be able to help me either because he has just lost his business and needs finance to start again.
