Lodger Leaving Deposit Return etc

    Yep, that's the one!

    I want to keep things amicable and to be honest I am fine with her being here until the 19th because I have someone new already but she does not need to move until after the 20th. She is not impossible to live with since I gave her notice and so far things have been amicable. i.e she still empties the dish rack every day, empties the bin, little things like that.

    I just don't want her to think that she is doing me a favour, which I feel is implied by her asking me to sign the letter.

    I was thinking of talking to her first and telling her contractually she does owe the rent to ensure that she knows it is me doing her the favour by allowing her to stay, but I will accept the deposit in lieu as from what I have seen, she has taken good care of her room and bathroom and putting some caveats in that if she has another party or abuses the utilities then she is out the door that day.

    Does anyone have any comments about how many days rent she should pay for if she leaves on the 19th? Is that 18 or 19 days rent she needs to pay?

    Would you ask her to pay a little rent as I will only accept eg 50% of the deposit in lieu of rent?

    I'm no fan of landlords as most always turn out to be complete !!!!*rs. I have good reason for my anger. A Landlord tried it on and kept my sisters deposit without good reason as house was left spotless and all bills paid for. We took this cretin to a small claims court in the end and got the money back. :)

    However, in this case the woman is clearly out of control.

    P.S Thank god I'm going to buy a deluxe caravan and be rent free from arsey landlords. Mortgage is also a waste of time, unless you're rich, no, super rich. Snobbyness to aside, its a great way to save up serious amounts.

    As you have someone already lined up to come in after the 20th, I would suggest sticking with the original dates, leaving a margin where you do the favour by not worrying too much if she does not move her stuff straight away. If she does get difficult, you may be glad of the time and your new lodger may be glad to have some extra warning that getting the old lodger out is not working.

  • Whichever date the lodger leaves, I would take meter readings and do a quick calculation to determine what share of the bills the deposit would be offset against but I'd still expect the lodger to pay the extra19 days rent now just to ensure you're not left with insufficient funds to be on the safe side. There's nothing worse than being left with massive utility bills after a lodger has left when you've already returned their deposit.

    She said she will write me a check before 12pm today for the rent up to 19th October. She said bank transfer but I said no, I prefer cheque.

    Cheques can bounce, you won't know for five working days! I would definitely not accept using any of the damage deposit in leiu of rent as this lodger has already shown a lack of respect for your home and personal possessions.

    Is bank transfer better then? She did offer (and seem to prefer) this method.

    Bank transfer will be 3 working days and you'll be able to see it in your account. Once there, it's yours.
    Cheque will take 5 + days to clear, and even then it is not guaranteed - it can be returned! (there are many scams based on this fact).
    I'd opt for cash as preferred option, then bank transfer

    Oh - unless there's a cheque guarantee card (usually up to £100 only).
