Broken badminton racket

About 5 months ago, I bought an expensive badminton racket brand new. During the 5 months, it has seen very little play but recently it broke at the handle during a back swing. It has not been banged or clashed with any object.
I have contacted the store that I bought it from and they say that a refund/exchange is at the discretion of the racket manufacturer. He indicated that it was unlikely that they would refund/exchange as it had been more than 3 months.
According to this: http://www.consumerdirect.gov.uk/after_you_buy/know-your-rights/SGAknowyourrights/ the company/manufacturer is responsible for proving it was not faulty when they sold it because it is within 6 months.
Does this apply for badminton rackets as well? I wasn't sure if wear and tear came into play with it. The racket has seen less than 10 hours play so I'm 100% it is a manufacturing fault.

as you have found out it is for them to prove it was NOT faulty under the sale of goods actt so contact consumers direct for letter templates and advice.Back by no demand whatsoever.0 -
