If you ever get suspended from work for accusations you know nothing about. How do you think you would feel?

To get no information from you Ex employer even when you have corresponded with them in writing is more than fishy!!

They never followed any procedure!! except the suspension on full pay while investigating, then after all that time the only correspondence you recieve is your P45.
more letters to them and 5 more days waiting for the information that was requested.

I have received no written information about the accusations made against you.
I have not been invited to a Disciplinary hearing.
I have not been given an opportunity to defend myself against any accusations.
I have not been informed in writing that i was dismissed and the reasons for my apparent dismissal.
I have not been given an opportunity to appeal my apparent dismissal.
I would appreciate a response within 7 days.

Then ET1 form gets sent and i contact a legal representive.

for not following the disciplinary procedures and defamation.

    is that good enough?

and thanks for your comments and assumptions that i commited a crime.

Post #32 is full of gobbledegook.

    Who is it addressed to?
What are you actually asking for on here?

Did you seriously not go to work for 16 months?

Did you call them to find out what was going on?

I have received no written information about the accusations made against you.

Did you mean to say "accusations made against me"? It's very confusing.

Because by then you've blown your chances. That's it."

It is confusing and to be honest, you need to speak to someone at ACAS as we can't advise what to do when we don't know the ins and outs - for example was it 2008 or 2009 that you were suspended?

Get a list of what happened when - in bullet points, and call ACAS and ask to speak to an adviser.
  • Very strange. If I was wrongly accused of theft I would do everything I could to clear my name as soon as possible.

Not really sure what this means - what was requested and what is the "5 days "aspect of it?

When did you write the above to your employer? I hope that is just a quick list of things and you didn't actually write it to them like that?

Then ET1 form gets sent and i contact a legal representive.
Who sent the ET1 form and when, and what does your legal representative say?
Have you only recently got legal representation?

for not following the disciplinary procedures and defamation.

is that good enough? It is a start but it doesn't explain much

You said you waited from 18th April 2008 until 20th August 2009. Only then, according to your original post, did you contact your employer, after you received a letter from them?

Is this correct or are you only drip-feeding information onto this thread?

At the very least you should have had a copy of the disciplinary procedure to refer to.

I find it hard to believe that you did nothing, after being accused of theft, for 16 months.

Interestingly the OP didn't say in their first post that they weren't guilty of the theft for which they were suspended. I await clarification with the rest of you, but usually people say when they weren't guilty, don't they?
I must say with all the encouraging & supporting quotes on here, I'm not suprised blaidoug isnt answering, ever heard of "innocent till proven guilty", not so on here me thinks!! this company sound guilty as hell as far as I'm concerned. Suspended for 16 months, no disciplinary, no appeal, no correspondence!!!!!!!!!!! Gud Luck Blaidoug you cannot lose

To be fair, we've been asking questions because this just sounds so bizarre, and what the OP said was:

was suspended on full pay, from work on the 18th April 2008 on the basis that i committed a theft from work,
Which is just a strange way to say "I was wrongly accused of stealing" if that's the way the OP views it.

I don't know if he's guilty or not, I'm just surprised he hasn't said he's not if he believes he's not. People usually do - sometimes they say they weren't, sometimes they say they messed up and didn't mean to do whatever it is which has got them dismissed.

And he has STILL not clarified whether he heard nothing from work for 16 months, or 4 months. Anyone's fingers can slip and put 2008 instead of 2009, but it really is hard to give decent advice if we don't know what we need to know in order to give that advice.

blaidoug, if you don't like what you're hearing from us, have you phoned ACAS?
