6 year old debts

Over the years mainly in 2003 i accumulated a lot debts as i couldnt pay my bills they is quite a few many i dont even know.

I have a debts for three years of water not sure how much around 2000 before whatever interest. A old car loan 1200 with a ccj small cash loans a few of them maybe 6 or 7. I also have bee told in the past that i have a 3000 minimum owing to council for damages to my previous property.

I have a old mobile phone debt about 450 back then and a halifax current account which had mounted up charges through failed direct debits.

None of them have been contacted me regarding them and i havent made payments any of them since 2003 but i am very worried that they will eventually contact me.

I dont what to do about them and darent contact experian in case the debtors find me but dont know what i owe to whom apart from the information above.

I dont have a lot of money as i am a caraer for my girlfriend and also suffer from depresson which how many of these debts have occured. I now have two kids and better life and achieved budgeting lol and havent got any debts since 2003.

Th eutility bills i just couldnt afford to pay and had to leave my previous property quickly due to harrasement etc. I am not sure what i should do about these if anything i am writing this in the hope of some advice about what i should do. I just live my life in fear of these debts and now i am finding hard to cope with worry.

I have read a lot about debt such as zombie debts after 6 years etc but am unsure which debts would have ccjs but i think the water would have although i hope not. Im not sure what i can do about utility bills as they are not subject credit agreements or mobile phones.

I would appreciate any advice, thanks in advance lee

  • After 6 years as long as you dont recognise them as your debts then they can be wiped. Think its called a statute of limitaions act.

    I'm sure someone else will come along with more info.

    Any debt you have not paid for 6 years is statue barred in england (5 in scotland). There is an exception, if there is an outstanding CCJ against them, which by the looks of it you have one on the car loan.

    If any debts which you have not paid towards, which are over 6 years old and creditors chase you, send them the statue barred letter.

    With regards to the CCJ, i believe the debt is still valid.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    Yes the debt is still valid if the creditor has obtained a CCJ within six years of the debt being due.

    Ultimately you will have to own up to the debts - worst case if you can't afford to pay them and have no assets then it might be worth looking at going bankrupt - it will give you a clean slate and peace of mind which by the soudsn of it may very well be worth it for you?

    It might be an idea to save up what you can to offer some full and final settlements later. I don't believe debts owed to the authorities will be statute barred - they may be exempt. Hopefully by the time you manage to get 3 or 4 thousand saved most of the debts will be statute barred. The CCJ may not be enforcable if they have not had payment for 6 years - they may need the court's permission to enforce the CCJ again.

    Do remember that the courts CAN make exceptions on the statutebarred rule if the creditor can prove they have done all they can to track the debtor and obtain payment and the debtor has purposely moved to avoid meeting their obligations... I don't know if any have ever tried to push that through but something that certainly used to apply...

    I think Fermi posted something about this - it was along the lines of the debtor had not stopped the creditor from enforcing the debt, only that their location may not have been known. There was nothing to stop the creditor enforcing the debt through the courts with a CCJ etc.

    I dont know if i have ccjs for the water bills but i think its 99% certain they is water usually do dont they?. I have about a 1000 in savings that would mean i could offer about 25% of the three water bills and my car loan as final settlement would i stand a chance at that ? thanks

    There maybe a scheme provided by the Water Board whereby you pay the charges for 6 months and then the arrears are paid off.

    Depends if they could argue that they couldn't serve the CCJ papers as the debtor purposely moved away to avoid it... grey area I think and one I honestly don't know how a judge might view - I would say it could go either way...
