  • Hi i was just reading some of the stuff that you have posted......how do I know if they used my deposit for PPI? I payed £100 cash deposit.

    It will say on you CCA.

    It will be split into two sides. Left hand will be concerned with the car itself. Value of car etc deposit and will then give you a total figure. The right hand side will be concerning PPI and other insurances. By right the £100 cash deposit should come off the left hand side but im guessing it will be somewhere on the right hand side. Something on the lines of £1000 ppi, £400 another insurance, £400 another insurance then ' less £100 deposit = £2700
    This side will then be added to the other to get a total whopping extortionate amount and with added apr etc will give you your total monthly payment.

    Thats the hard bit as you need to know the legal bits. Have a look at the last link and i would basically ask for the money back. Ask them a list of questions including ...Why have you taken the deposit from the value of the insurance and not the car.. Go on to say.. as you are aware this is against the law etc etc. Also it was miss sold as you were told you had to have it, was not advised of the conditions etc etc.
    Send it recorded and give them 14 days to reply.

    This will be recieved and they will fob you off.

    Send it again asking the same questions or ones they have not answered and this time state you have been seeking legal advice from Stephensons solicitors. (Will show you know what your on about) and any unsatisfactory answer etc you will have no alternative but to take legal action and they will be forced to explain the above questions in a court of law.

    This will either give them a kick up the bum and make you an offer but as you have paid the balance off im thinking they will fight it and hope you go away.
    After this bit is the hard bit on what to do as court will only be the way to pretty much get it back, though with that much bad press etc etc im sure the judge will look kindly and all of these cases anyway have always been settled out of court as, if they are forced to admit or found guilty it will pave the way for everyone to claim and have the right to get their money back.
