How are they supposed to know there is a problem with your records without checking them ??

You paid for something to be done - they did it - just because it wasn't the answer you wanted doesn't justify you claiming that they have charged you for something they didn't do !

    Incorrect.

The OP required a service, but knowing his records would be required, he checked with the receptionist to see if his records were there.

The receptionist said yes, the records were there.

The OP then paid the £40.

The receptionist is at fault and made a mistake stating the records were there, when they weren't. If she'd said they weren't there, the OP would not have paid £40 for the service, as it would have been impossible to carry out this service!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Surely you need to determine precisely what the doctor means by a gap in your records?

The receptionist may not have been aware of the 'gap' in the records. That may have only been apparent to the doctor reading those notes.

What precisely does the GP charge the £40 for?
    Looks like they've written "I don't know", which ain't worth 40 squids...

It could have been worse. It could have been 40 guineas.

I've just spoken to the practice manager, she said they shouldn't be charging for that and they're going to destroy the cheque.

    Thanks for all the replies!
