can't prove parcel was delivered wrong address

Hi everyone!
I really don't know what to do....I ordered an item online and paid with paypal and was supposed to receive it within a week. When I inquired about the item, the company said it was delivered to "my address" by Essel the following day and someone signed for it, they gave me the name of the person who signed for the item, but I don't even know who it is
.
Now I email the seller and the seller said Essel insisted it was delivered to my address:mad:.
Obviously it was delivered God knows where and signed by God knows whom, but how can I prove it to them and resolve this issue quickly? Otherwise my 50 quid were wasted...

Seems odd. Why should it be you that has to find out what happened to it? Isn't it the seller who has to prove that they delivered it to your address?
If it was signed for by somebody that doesn't live at your address, that seems more like proof that they DIDN'T deliver it to your address.0 -
Interesting question, a lot of courier firms leave stuff at other addresses. I had a £300 tent delivered to my next door neighbour whilst I nipped out, they are great and it was no prob. however where does the law stand if the stuff just goes missing?
As you paid with PayPal can you not claim on their payment protection scheme? I thought it covered all transactions over £15, but maybe I'm wrong.0 -
hi there, i had a similar situation but with royal mail and their special delivery process not so long ago.
The seller had to contact the delivery company for them to investigate (as stated above). Because they couldnt prove where it had actually been delivered to they had to refund the money via the paypal protection scheme.
I had to provide names of people that lived at this address.
Just for good measure i also included the names of my 2 neighbours aswell (only with their permission though).

I'm in an email argument right now with Marks & Spencer as to whether or not they're allowed to leave my order with a neighbour or "in a safe place" if I'm not in when they try to deliver. M&S are especially bad about this. I once saw a huge bunch of M&S flowers left outside a neighbour's doorstep to wilt and die. They were there all weekend as the intended recipients of course did not know to expect a flower delivery and had gone away for a weekend. I'm sure M&S will have replaced them but it's not very nice, coming home to a bunch of dead flowers on your doorstep. Not very nice for the sender, either.0

If you order something online and don't wish for it to be delivered to anyone but yourself at your address, make sure they know you want to sign for it as then they are only allowed to leave it with and get it signed by the name on the parcel. I hope this makes sense. You can also leave a not saying not to leave it anywhere else.0

The M&S ordering process doesn't give the customer an opportunity to give instructions. And their emailed acknowledgment of the order doesn't mention that they might leave it outside, and as far as I could find, it's not in their website t&c. (It's always possible that it's there and I just overlooked it.) It's not until they send an email notifying you that the item has been dispatched that they tell you they might leave it with a neighbour or "in a safe place", and what's worse, their emails are set up so that you can't reply to them, you have to go on their website and use a form.
Never mind -- I reckon that if it does go missing, their reply to me proves that they were notified of my objections, so armed with that I should be able to demand that they replace the order. Next time I order from M&S I'll use the "Deliver to Store" option.
Getting back to the OP's problem - have you contacted PayPal to see what they can do for you? I don't think the seller should be allowed to get away with just claiming it has been delivered to your address.0 -
Thanks a lot for all your replies, I contacted the seller through paypal now and still awaiting feedback from them, and if they don't reply in a couple of days, I will escalate it further. Hope I will either have the product sent to me again or money refunded.0

Depdening on the courier company, they can GPRS track the courier. It means when they say they've delivered to Mrs Smith at No. 21 Long Road, they can see it on a tracking system.0

GPRS is something entirely different.
Anyway, surely that would only show that the truck was somewhere near (or maybe stopped near) 21 Long Road.
Will it really be able to see Mrs Smith take delivery?
Will it even know when the parcel left the truck?0
