  • I really don't think it matters.
    If the order form said manual and the garages wanted to be !!!!'s they could keep her deposit and or sue for extra cost's.

    As they have offered her deposit back we can assume a) that the order form said manual but they admit the mistake or b) it says automatic so the can't really argue about it.

    Either way for 99% of the main dealer groups the terms and conditions will say something like the following:

    The seller will use his best endeavours to secure delivery of the vehicle and the accessories on the desired delivery date or dates but shall be under no liability whatsoever for loss occasioned by delay in delivery.

    Should the vehicle and accessories not be delivered within three months of the desired delivery date the Retail customer may by giving written notice to the seller cancel this contract and thereupon the deposit paid herrunder by the Retail Customer shall be returnable in full.
  • Audi did this to me a few years back - car ordered - my order form splet out exactly what had been ordered with options.
    When it came it had wrong colour interior, and was a quattro (not ordered). Dealer was most embarased and said that I had three options a) agree they were hopeless and refund of deposit b) they order new car again c) reach and agreeable soloution on the car outside that they had already registered in my name.

    We agreed on option C with a bit more discount on a higher spec than ordered plus a few extras chucked in.

    Turned out that sales guy had gone on holiday day after I ordered it, and girl in office had placed factory order without confirming the final spec with me.....
  • Yeah it happens more than you would believe.

    The best i've ever known is a customer ordered a Grand Espace (one of my ex colleagues) , girl in office had a dizzy moment and ordered an Espace everything exactly the same. No one noticed when it arrived not even the customer. They bought it back a few weeks later because they'd parked next to another one and realised there's was shorter. Doh

    We let them continue to run about it that while we found a Grand Espace pronto. Then with a lot of hassle managed to get the original car de-registered and put it on as demonstrator. Customer was fine these things happen.

    I guess its how you deal with it. As i've mentioned before i've covered what the garage can probably legally do, what they do beyond that depends how much they value their reputation.
  • As stated there doesnt seem to be much the OP can do apart from getting the deposit back. I would be really annoyed too, disappointed and inconvinced !

    I would defo give the garage some hell, perhaps in a show room full of potential customers;)

    i would get my deposit back and go else where theyve cocked it up once who's to say they wont do it again ?

  • I've had the same problem, a few years back on a mk4 fiesta. It was to be my first new car after not smashing my old learner banger to bits.

    The deal was £5995 for a 3dr bare bones basic model, in either red, purple or blue. We ordered a red one.

    3 weeks later we got the call to go and collect, and found a 5dr, white 1.3L (list price around £8k) :eek:

    After much screaming from my dad at the sales people (he'd put the car on his credit card) we came to an agreement that i would keep the white one, but at an additional cost of only £350, as it was THEIR c*ck-up!

    We mainly got them to agree when my dad stated that as an 18 yr old with no NCB he would be billing them for the difference in my premium for a 5dr instead of 3dr, the bigger engine and extra car tax costs.

    They quickly agreed to simply charge us £350 which was the cost of having the arctic white paint job lol.
