Dj Let us down

Hi
We paid a DJ £150 in advance and a week before hte wedding he let us down and told us he didnt have adequate insurance to do the job (despite this being agreed before payment was given)
He has refused to return the money to us.
We would like to take him to court. I'm looking at sending an initial letter under the Sale of Goods and Services Act 1982.
Is this the right route to go down in this situation?
Thanks
Kev

Oh that's awful.
What reason did he give for not refunding?!
I would send an intial letter, asking for a refund and perhaps giving him 14 days from the date of the letter to respond, or you will be taking him through the small claims court.
Did he give you a receipt for the payment?Tank fly boss walk jam nitty gritty...0 -
Unfortuantely we paid cash and did not get a receipt (he was a mate). so not sure how far we can pursue it, but a threatening letter backed up with some legislation may do the trick - hopefully.0

Speak to your local Trading Standards office - look on your Council website - and ask their advice. They may even offer to write the letter for you, which often gets a better response

Nice mate!! I can understand why you trusted him though, not to get a receipt. You don't think that a friend will let you down!
I hope you can sort something out.
Finally decided to start growing up when it comes to money!:j

How awful! Maybe a well worded letter will help to sort him out, but with no receipt or other proof you may find it difficult to pursue it. Sorry I can't be of any more help but didn't want to read and run. Please keep us updated on what happens. Everyone else reading this please make sure you get a recipt for your wedding services.

you might get some better responses on the consumer rights board there are some very "in the know" people on there.
Looks like a bit of a tricky one though seeing as there is no proof of purchase as it were.
Hope things get sorted.0 -

Thanks for your replies so far.
There is a facebook thread about the arrangements, so there is a bit of proof, including arranging to hand over the money (except nothing to say the exchange of money actually happened).
I have now drafted an initial letter demanding a refund, giving 14 days. I will do a letter before court next if i dont get anywhere. Hopefully the threat of court fees and interest on the money will prompt a payment.
Thanks again0
