consumer rights regarding NUS card

Hi, Last year I purchased a 3yr NUS card as I study with the open university. Got it through no problem. I was "supposed" to receive an e-mail sometime in august with a link which would enable me to order my card for this coming student year but no e-mail arrived and I have no student card despite having already paid for it.

I have tried to e-mail them numerous times but have yet to receive any reply (they say a maximum wait of 10 days), I have rung them but keep getting a pre recorded message saying they are receiving large numbers of calls and cannot answer mine and to leave a message (which I have). It doesnt matter what time of day I call I always get this message.

What can I do? These people have taken my money and I am really angry at not getting what I paid and not getting a single response from them. What rights do I have?

  • Its right at the start of the uni year so i reckon with around 100 kids starting uni plus those who want to start with the open UNI the NUS card people may be a little overwhelemd right now.

  • I'm not denying they are going to be busy but still I am not getting something I have paid for. Just because I paid for my card last year doesnt mean I should sit back and wait for them to deal with all the new paying students before they get round to sending me mine. Put yourself in my position.

    lesleydenise - I can understand your frustration but im merely pointing out why the phone is going to answerphone. probably the same with the email...

    Im not sure what yoruo rights are as it may be the same case as with teh student loans that have taken an age to get through...

    You just want cheaper beer dont you ;)

    Do you have a contract or any terms & conditions (maybe on the NUS website)? If the contract infers or implies that you should have the use of the NUS card by now, you could send them a recorded delivery letter headed "final notice before action", say why you believe you should have received the card (i.e. you have paid for it and the terms imply that you should have continuous use whilst you are a student or whatever) and say that if you don't receive the card or a refund within 14 days (and possibly compensation for your previous inability to use it) then you will sue them.

    I'm no legal expert (so don't just take what I say as gospel!), but you should be able to make a claim against the NUS via the Money Claim Online website set up by the government: http://www.moneyclaim.gov.uk/

    add 600k to the 10k and you may be halfway there.......around 14,000 started in my city, and the student population for two unis is 40,000.....someone's well off there
