Trying to obtain Original Signed Agreement from Barclaycard

Hi, I have sent a letter to Barclaycard using the templates from this website, requesting a credit agreement for my account. I am in debt with this account and as a result of this and other debts I have I am using a debt management plan through Payplan. The debt management is going really well but im trying to still reduce my debt as much as possible. In regards to my debt with Barclaycard I am certain that I never signed anything from Barclaycard, hence the reason why I would like to obtain this document because I strongly believe this doesn't exist. Are Barclaycard under any obligation to povide me with a copy of my SIGNED agreement? In response to the letters I sent to them, they sent me a generic terms and conditions that is supplied to anyone upon request, rather than a personal document that is related to my account. They also said that they have fulfilled their obligation under the consumer credit act 19?? by sending out this document around terms and conditions. Is this right?? Surely im entitled to get a copy of the document I SIGNED?? ANy info would be great!

    you get a true copy of what the terms were at the time of the agreement, if you sar them whichyou pay £10 for they will send you a copy. Did you get the card via online banking or branch>

    Yes they should send you a copy of your agreement, not the terms at the time of the agreement! Therefore read here and you'll see the letter you should send - page 1.

    Was it just terms and condition though? When I applied for my Barclaycard online a few years ago, it was by electronic signature.

    In which case the tick would appear in the signature box, although as I stated previously this should not be dwelled on too much right now - check the remaining prescribed terms :D

    Thank you to everyone that has replied. I have just had a look at what they sent me and it says it is the terms and conditions of agreements between Sept 2004 - Jan 2005 and there is no signature box at all, anywhere on the document. The way I got a Barclaycard: I opened a student account around Sept 04 and I didn't ask for a Barclaycard and therefore didn't sign anything. About 4 weeks later I got a Barclaycard through the post. I am positive that I didn't ask for this and therefore didn't sign.

    Also when companies charge to check agreements pre 2007, what is it exactly that they are looking for?

    You do not pay anyone and pre 07 will not be made unenforceable, they can be but rare so forget that! the relevant section was repealed so no provision for it - if you pay a company then more fool you!

    Im just a little bit worried because the templates are very similar to the one I sent to Barclaycard in the 1st place and in their response they said that by sending me the terms and conditions they are filling their obligation under section ?? of the CCA 19??

    Also with two of my other debtors I have sent out follow up letters as they haven't responded. What can I do if they then fail to respond to that, or am I going to have to get other people involved?

    Well if you go back to the thread and post there we'll help you with a reply to Barclays, but read the thread and you'll see what to send back! Page 1, letter 2!
