    I would indeed send a copy of both the agreement with the clause in question circled and a copy of the collection notice. Advice them you consider the matter closed and look forward to a letter confirming that they will correct the legal matters and so on otherwise you will have no choice but contact the ombudsman :)

  • I have a claim in with the ombudsman for my Black Horse agreement to but i went through trading standards first, Monica have you paid over half of the value of the loan, even if you havnt though I dont think they should be charging you the full amount of the loan.

  • You have a present an N245 court form that firstly you need to return to the court with an offer or repayment.

    Bailiff action - ok what are they looking to repossess?
    Don't let them in etc.

    Black Horse, if you have paid over half back and have returned the van they can still charge you for the remaining balance.

    You need to enquire how much the van sold for etc.

    Black Horses clauses in respect of claiming the goods are worded that they would look to settle for a sale of the van, but they usually ensure that you have to repay the balance that is outstanding.

    (6944.60 / 13719.62) * 100 = 50.618%

  • In my agreement with black horse it states you can return the vehicle after half the repayments have been made, I asked if I could return the car and the only money they asked for was my late payments
