As I said, what sort of total loser would even consider legal action?
It would get laughed out of court and what would you do when the seller, crap as they may be, says that they haven't got it anymore? Going to take the new owner to court too?
All the "legally binding" fluff means sweet FA. You can't make a seller sell or a buyer pay but hey, fill your boots if it makes you feel better but neg feedback would seem a more appropriate response.Terms & Conditions Apply0 -

Yes I sell, very well thank you, but, shock horror, I also buy!
Sometimes I buy a bargain and sometimes I miss out. Sometimes the seller hasn't got what they wanted for it and won't ship and sometimes they will. Being a grown up I take it all in my stride.

I know getting a refund is easy, but whats the chances of forcing a sale or if needed suing for " loss of bargain".. in the dishwasher / water butt themes that ran on MSE

There are plenty of examples on these threads of people not wanting to pay for postage, people who agreed to pay a P&P then yapped and whinged about it later, people who have listed 99p BINs, not auctions and lost out, people who get upset that they have to pay a 5p listing fee so as not to lose out on free postage categories....

Seems to be far too much of this "I'm going to sue" culture with ebay nowadays, was not like that 8 years ago when I first joined. Are we slowing trying to revert to being American?
I have over the years had about 3 or 4 cases where I won an item cheaply & seller would not honour it. They were negged & I moved on, really not worth the hassle doing anything more.0 -
I think we back down far too much. If a professional seller wont abide with the law, that is their lookout.
I would sue. They have to pay costs and travel to your local court to defend. Others had the same attitude with B&Q and after a bit of work, I have to say B&Q are up to their neck in claims etc.0 -

I would rather have the item I paid for !
the amounts aren't massive, but its getting silly if you bid and win an auction ( above reserve but don't get goods )
Not only Have I lost the bargain , I have lost time and otther resources ... ie have had to use another (more costly) method for my work whilst waiting for the auction to finish , and the time afterwards ... In that time I could have gone out and paid for the item - alot more elsewhere , but didn't.
Do you think the seller would have been happy if other bidders meant my max bid was hit, only for me to say- sorry I've brought one eleshewhere now.
I'm about 50/50 buyer/seller - and go back on ebay a long time - have never not completed my side of the bargain - and thats with a fair few times when I've had sellers and buyers remorseAny posts on here are for information and discussion purposes only and shouldn't be seen as (financial) advice.0
