    Thanks for the replies. Yes the CSA are involved. DH paid via voluntary DEO for a while, but was paying an extra £1 per week in admin charges to his firm. He then paid the CSA via SO for a while. After recently notifying the CSA of a change in circumstances, he was informed that his case had gone clerical and was now being dealt with at Stockport. Hes was told that because his case was clerical he could no longer pay by SO - it had to be either via DEO or direct pay. He didn't want to pay via DEO so has had to pay her direct. He would prefer not to do this as he prefers not to have contact with her but he now has no choice. He has always paid on time and has never had arrears.

    What I find hard to understand is that it was only when he notified them of a change that they told him about the change in the way he pays. If he had not told them then we assume he would still be paying via SO!

    He has paid today and has written in a duplicate receipt book. He included todays date, his name, who he was paying, how much he was paying, the period of time it relates to, the fact that it is maintenance and the names of the children it is for. He then wrote 'I have received the above amount' and PWC has signed it. What's not surprising is that the CSA haven't even sent her a letter yet to tell how much she will be getting!

  • I don't see why going clerical means your options of paying are limited but maybe someone with more knowledge of the csa will be on to advise:confused:

    It has gone clerical because only one of the 2 children stays overnight with us. Reducing the maintenance by 1/14th was too much for the CSA computer to cope with apparently!

    They sent us a letter with the new amount, but no schedule. He has overpaid for about 6 weeks but there is no mention of this so at the moment he is paying the new amount but is 'in credit'. Not by much though so isn't going to lose any sleep over it.

  • I would really insist on talking to someone more senior than your case worker as although in your eyes you may be in credit it may not work out that way in the end. Someone else we know had their case go clerical and they weren't requested to actually make payments for 6 months (although they were advised to put money into a seperate account for when their assessment was worked out properly). Now i'm not suggesting you do this but if she isn't trustworthy and you leave any gap for error she will be quids in:rolleyes:. Have you told them you are happy to pay by direct debit via the csa? (if you are in fact happy to pay by this option?). Both sides need to be protected when it comes to child maintenance, they need the money to live and you also need to be in a position where you don't end up paying twice!

    that's no real reason for a case to go clerical. they should just knock off 1/7th for one QC.

    then again, with those incompetent muppets, i suppose that would be too technical for them.

    i imagine it would be far too taxing for their brains to multiply the number x 0.857.:rotfl:

    He is still paying on the date he has paid previously, so we're not worried that they haven't sent a schedule. PWC signed the receipt even though she hadn't had a letter telling the the amount due.

    We would definitely not pay be direct debit. I still think it's wrong that we have to pay direct. But the CSA are so useless and inefficient that we can't be bothered to argue the toss about paying by standing order. We will just pay her directly and make sure we get the proper proof. And actually I think it's good that the children see that their dad is contributing to the things they have.

    not quite.

    if you take it to appeal, then the PWC will be required to supply her bank statements for the account you have been sending the money to.

    bank statements don't lie and are pretty much the only concrete evidence you will get.

    carbon books, reciepts etc can all successfully be denied and classed as forgeries by the PWC.

    basically, when dealing with the csa, remember, the NRP is scum and if the PWC claims the reciepts are false, you're stuffed cos they will take her word as gospel and leave you with a stack of incorrect arrears.
