  • I have a litle news to shar with you now.
    The bank loan has been referred to the omnibudsman,
    the credit card came up trumps and with no arguement payment and for more that I thought however it was a token payment
    The catalogue responded you took this out in 1999 we were not a member of....... you have no recourse of refund/claim
    The mortgage company - absolutley nothing!
    I shall be chasing every avenue now. As a result I shall be reffering the mortgage to the omnibudsman as they have not responded to my letters in the given timescale considering the letters were first sent out in September

    Who is the actual insurer?
    You could try pursuing through them instead as they are also liable as well, many have now gone this direction where the insurer/underwriter will have been governed, in this case the FOS can judicate this for you if it comes to this.;)

    Pusuing it, I think I am just beginning! I didn't really realise before how many things I/we paid fo before investigating our fineances

    lol, well keep it going until you get somewhere.......:D:T:T.

    One of mine was not governed and the FOS returned them to me, until it was suggested on here by going the insurer direction.
    Even though the insurer denied responsibilty the FOS have taken it on.
    Write to them as you did with the other and give 8 weeks, if they do not accept this then as usual go to the FOS.
    The insurer also have 8 weeks in full to respond.

    So does this mean that the reply from the catalogue was 'we weren't governed by ... when you took the insurance out' does that mean I still have claims for recourse using the actual insurance company? If so how do I find out the catalogue insurance companies details?

    I don't think all catalogues or even any were actually covered until Jan 2005, although you could double check with them first, but the insurer would or should have been I believe.
    Give the catalogue a ring and ask them for details of the insurer, they should let you know who they are/were, if they can post the details that would also be okay too.;)

  • Thanks for that, I shall chase the insurer. I must say that in the letter saying that I wasn't going to receive a refund they stated that I had taken the insurance out in Oct 1999 - and that it was sold via a telephone call and the caller would have made certain that I was eligible for the cover - now that was is pretty bizarre as I know for a fact I wasn't! I was on maternity leave as of July, 1999 and didn't return back to work until September 2005.
    Actually I can say that I didn't think it went back as far as that!
    We shall see what happens.

    Hi, did your letters to them request that they look into a complaint for misselling of the ppi's or just to ask for them to actually give you details of the the PPI you have paid? If you have not already made the complaints to them then you can still do this without any more information from them. If you have already made the complaints then its 8 weeks and then you should get a final response and the option (if they do not uphold them but fingers crossed they do;))to take them to the FOS.

    Always post all correspondence by recorded delivery so you have a proof.

    If they say you arranged the insurance in a call then they must have a copy of this call to be so sure. I would request a copy from them.
