help with divorce settlement please

im sure i will have posted in the wrong place but couldnt find anything that looked like the right place.. (please MOD feel free to move to where it will be best suited)..
My DP has filed for divorce and his ex is now asking for her claim of his pension.. can anyone tell us how much she will legally be entitiled to as, so far we have not got a solicitor and just want an idea of what it is going to cost etc, many thanks to anyone that can offer advice at this stage.. Pash x

    Is there any children involved at all? How long had they been together? How were they both contributing to the home etc?

    I think it all depends on the above factors including how long they were together etc.

    Have you got help from solicitor or even your local Citizens Advice Bureau

    just one "child" but 19yrs old now. they seperated 6 years ago and everything but pensions was sorted then.. so hopefully this is the last thing to finally make the break
    no solicitor as yet.. just trying to get idea on how much etc!!!!

    I think its too hard to say as it all depends on the amount of money he is going to get - you really need to speak to the professionals like solicitor or CAB who will tell you what she will be entitled to.

    I'm sure from my divorce that the ex can get half the pension and that can be asked for upon settlement of the divorce . I when i got divorced agreed to not touch his pension if he let me have the house . I say let I took over the payments and he signed it over to me .
  • Remember that with pensions if you are offsetting half of his pension it isn't pound for pound - The case of "Maskell vs Maskell" set the precident. Basically something payable some time in the future with an unknown value (if he lives), that is subject to the vagiaries of the stock market is only worth about 25% of its value now. The other point is that you cannot get at it till retirement time either if you split it.
    The quicker you fall behind, the longer you have to catch up...
