parking fine in Newham

hi i have recived parking fine today 28/09/09.
the story:
i have parked my car on Burges Road , Newham at 8.28am on 11/08/09 got my ticket at 8.29am and when aproching my car i have found traffic warder was truing isue the ticket so i have told him off 9nicely, no swaring :mad:). get he ticket in the car and went to dentist. when i retur to the car no panelty ticket was isue until today. i have called council and they told me the traffic guy have give me the ticket to my hands (that's what she has on file) but it' not tru anyway. i have found the ticket in my car :j. i`m lucky as it was over a month ago.so i can copy the ticket and post it with appel.
But
what's happend if i didn't have the ticket, i gess i will have to pay.
so
can i ask for any compenation for time and stress they put me on.
did they breach any law. they can`t just write tickets like that. not everyone will vbe lacky like me to have the ticket for so long.
any advice?

Sounds like a dodgy Warden.
Don't think your first appeal will be accepted BTW, it's not always that easy. You may well have to prove your defence to an adjudicator and this could go on for months - so keep your pay & display ticket and only send a copy of it with your first appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Coupon-mad is right, this does sound like a warden who needs 'supportive training'! The law says that once you have paid for the ticket, you're covered so provided that you bought the ticket and then walked right back to the car, the warden was wrong to issue the PCN. BUT if you parked, then went off to find change for the meter before going to buy a ticket OR you bought the ticket and went off somewhere else before returning to put it in the car, then you've not really got a case.
As well as appealing this (which will likely be rejected in the first instance at least), I would also write a letter of complaint about the warden who issued it as a separate matter (though this will still be the focus of your appeal). Basically the more of a problem the council think you are likely to make out of this, the more likely they will be to cancel the ticket. If you do complain, stick to the facts, don't embellish and remain objective, emotional or angry/belligerent letter will get you nowhere.0 -

i got the ticket 3 minutes before they issue the pannelty one. so he walkes away and then issue the ticket witch he never gave it to anyone.
for me that's not right for them to do it.
i'm not worry about the panelty payment as i will never pay that.
is thare any legal way i can take to make them pay for what they have done (i'm ok to take it to the court if need to). this was dodgy and i know it for 100%.

Similar thing happened to my OH in Camden. He had bought parking voucher at machine and put it on his car. Saw warden at end of road and thought no more about it. Then got parking fine notice in the post. He appealed and sent then copy of his original voucher showing it predated time of issue of penalty notice. Ticket was cancelled.
I think sometimes wardens are desperate to fill their quotas. My builder got one today. He bought parking voucher and displayed it on the dash but it slipped down and was sitting at edge of dash next to bottom of windscreen. So if you looked at an angle, bottom of voucher, where it says valid time period, was obscured by the smoked glass surrround of windscreen. It was easy to see if you walked up to car and looked but presumably they don't. He got a parking ticket for "not displaying ticket clearly" despite the fact that day and date were clearly evident. Similar thing happened to my next door neighbour - his resident's permit fell from windscreen onto dash. Got parking ticket for "not displaying permit clearly".
They are getting quite desperate to fill their quotas round my way. Trouble is that all this over zealous policing of anti social laws is making the population in general less law abiding. I know some people say it is the law so we must obey but when there are so many petty laws so rigidly enforced with no common sense or discretion, it brings the legal system into disrepute.
Still someone in the planning department told me there was a Planning Inspectorate visit about some major development and the inspector and various senior planners went up to the site to have a look and all got parking tickets....0
