Sendit.com-Sent second hand game

I placed an order recently for a game from sendit.com. The game has just arrived and it is clearly second hand, it's not in bad condition, the manual being slightly dog eared etc.
Where do sendit.com stand here......nowhere does it state that the sold game would be new, but nowhere does it state that the game is second hand. Seeing as I got a good deal I'm inclined to ignore this but is this really legal what they are doing? Are they trying to pull a fast one? or is it me in the wrong for assuming that i would be sent a new game? Opinions?

I had a similar experience with a game from Tesco (online).
It may be that the game was, at some point in it's life, displayed on a shelf in a shop, with it's contents removed and stored separately.
If the contents were not handled with due care, the manual may have become dog-eared and the disc may have finger-prints on it.
I am not saying that this is the case in this instance, but it might be something to consider.0
