WHo owns the car

I have a friend who has just split with her partner.
they have a car where the log book is in her name but he was paying the finance... so who does the car belong to? He says he's spoken to CAB and a solicitor who say the car is his but I thought if the log book is in her name then surely legally hte car is hers??
Any ideas on where I can find this information out?

If he's paying for it, why does she think it is hers? Viao is right - the owner and the registered keeper can be two different people, so the fact the car is in her name means nothing. There is a difference between "he was paying the finance" and if the Finance agreement was in his name?
I suspect the Finance agreement may be in your friends name along with the log book and he was making the payment? - If this is the case there are options?
Also is the agreement HP or loan?

The car is the finance company's until the finance is fully paid up.
Maybe the rules are different for different companies, but the company I used to work for had it in their small print that you couldn't buy the car on finance then let someone else 'own' it. (although I know alot of people did)

Who WANTS the car?
Whoever wants it should pay for it, then get the log book in their name. So if your friend wants the car, she should pay off the loan for it, and pay him back for anything he's paid so far.
If she doesn't want it, then she should just get the log book in his name, and hand it over.Should've = Should HAVE (not 'of')

It's a little complicated, they brought the car "together" but she isn't working as she has got a little boy so he was paying the finance.. If his sole name is on the Finance agreement then no issues.
However, if the finance agreement is in both their names then she risks owing the debt if he does not pay - he will have the car but the Finance company will come to her for the payment.
So, need to check the Finance is just in his name only0
