Switching insurance provider with a pending claim

I had a small rear to rear (both parties reversing) accident in Tesco's car park in May this year.
I do not have damage worth following up, the other party has tried to blame me 100% but my insurer will only entertain 50/50.
The other party have, as yet, not pursued the claim any further and so it hangs over me. I do not know if they will follow up or drop it, my insurer tells me they have a number of years before they have to claim.
At the end of the year I will get 4 years NCB (assuming they do not follow up) and wish to move insurer to get a multi-car policy.
If I moved insurer and the other party did make a claim who would I follow up with, my current (old) insurer or my new one?
Can I increase to 4 years NCB while this hangs over my, and remains as a threat for maybe 5 years?
If they did present a claim in a few years time how can I / they prove it is the damage from May '09.
Any advice in what options I have if any, would be much appricated.

The claim will be dealt with by your insurer at the time of the incident.
Your NCD will more than likely be downgraded to 1 year pending the outcome of this (if no claim ensues you should have the missing 3 years reinstated). The injured party has up to 6 years to make a claim against you.
The incident will need to be reported to any future insurer.0 -

So if I read you correctly I loss 3 NCD for up to 6 years, which seems a bit harsh.
I have just spoken to my insurer, who say that they are closing the claim as the 3rd party has not pursued it for 4 months (not sure if 4 months is a special amount of time to my insurer.).
I suspect the answer I'll get back from this forum is that 'the injured party still has the reminder of 6 years to make a claim'. However if this is the case then everyone would be running with zero NCD, or at least delayed by a further 6 years pending 'that stone chip your rear wheel throw up and caused a paint chip to the car behind'.
As the case is closed with no claim being made, do I need to declare it?0
