Hi Guys, any advice on this situation would be much appreciated..

We are renting a 2 bed apartment and have been doing for 4 months of our 12 month lease, we have been the first tenants to move into this apartment since the landlord purchased it.

Today, a lady came to the door to tell us that we were in the wrong apartment - and that we were meant to be in a completely different building across the road - and this apartment had been sold for the first time to a completely different person..and that we have to be out asap..they even offered to help us move to the other apartment.

Our tenancy clearly states we should be in this apartment, we contacted our landlord who has the documents to say he bought this apartment and not the other one as the lady said today. And that we aren't going anywhere..

It seems the apartment we live in has been sold twice, to two different people, due to someone's error somewhere...and only just been noticed...we dont want to move and It would be a massive inconvenience to move out of our apartment now, not physically possible for some time.. we shouldnt have to move out of an apartment our contract states we should be in..

Where do we stand in this, our landlord is not impressed either, and is looking into this further..

I hope the scenario made sense! Any advice appreciated..

    How can you sell the same place twiceand nobody notice? How is this possible?

    And if it is possible, anyone want to buy a house? ;)

  • Did this woman say who she was or where she had come from? She sounds a bit mad to me, maybe she's gone round to all your neighbours and said the same thing!

    But to echo a few other posters, this is not your mess to sort out, if she comes round again then I'd refer her to your LL, or ask if you can have her number to pass on to your LL?

    Also, don't let anyone but the LL into the flat for the time-being, obv you can still have friends/family in but if anyone comes and says they're here to help you move, or are connected with this fiasco tell them to sling their hook! I mean, this sounds totally ridiculous!! Though I am glad I'm not in your position!

  • The lady was from the agency selling the remaining units on the behalf of the developers. LL is looking into this, in the mean time no ones coming in! It is ridiculous, what rights would we have to stay where we are, we took this fat for specific reasons.. as the other wouldnt be suitable! hmm!
  • I'm new to this whole house buying lark, but are there not deeds to the flat? Do they both have copies? Surely you can't sell one property twice? How did you get the keys for that one, if its another that was purchased?

    Its all up to your LL anyway, not your problem, but I'd be going mental at them if I was him!

    Surely if two people have completed on the flat, then whoever completed first is the rightful owner?

    So your LL just needs his completion thingy, and compare it to this other person's who claims to own it, and see which has the earliest date on it.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
