Could I be refunded due to T&C violation

I recently signed upto a company website in which I paid for the membership.
It is nothing what I expected and I felt I was misleaded and want a refund.
I am wondering if I would be entitled to a refund but not sure due to thier T&Cs(stated below):

"For security reasons, we currently do not accept credit card payments over the Internet. To register and have your details made available on the Website, you are required to complete the registration form which is available on the Website (the “Registration Form”) and supply your name, email address and all details requested on the Registration Form together with confirmation as to which registration package you require. We will notify you of our acceptance or rejection of your application. If accepted you will be required to telephone our administration office on *** to obtain the relevant the payment details details. Should you decide to proceed with registration, you will be required to make the registration payment into the *** bank account and provide proof of payment in the form of facsimile to *** of the corresponding bank receipt. On confirmation from our bank that we have received cleared funds from you, we will provide you with an email confirmation of payment together with details of your membership."

"Without prejudice to your Cancellation Rights as set out in paragraph 4 below, all monies paid by you to us are non-refundable in the event of dispute, cancellation and/or termination of this Agreement. 4. DESCRIPTION OF SERVICES AND OPERATION OF WEB-SITE"




Now the registration form never had an option for different packages.
After this everything was done over the phone

I also never recieved any confirmation of payment nor did I recieve any membership details by email.
So in my oppinion THEY have violated THIER OWN T&C but I'm wondering because of them mentioning none refundable am I bound by that or there some sort of loophole because they broke thier own T&C

    You need to tell us which website it is, why you feel they have breached the t&c's, and what paragraph 4 states.

    The "security reasons" not to accept CC payments is so that you cannot do a chargeback. Any company giving those payment terms is one to steer well clear of because there is no way they want you to get your money back.

    If you feel that they have broken their t&c's you can always ask for a refund / take them to court. Good luck on that score.
  • Monies are non-refundable - there is your killer statement - basically they can use that to fit any circumstance so chances of getting a refund are very very slim

    No more so than the person who asked the OP the question. The answer to which you provided without a qualifying statement and which led to a site of adult interest.

    Somebody with a questioning mind might concur that the OP and your good-self were the same using different forum names and forgetting to change between the two :D
