    OP, from what you've told us it sounds like the other driver's fault to me. Fingers crossed for a sensible outcome which doesn't penalise you.

    she said he was going too fast,she was already pulling out & didnt have time to stop.

    At the time, she said to him it was her fault, she just hadn't been concentrating & pulled out.

    Whats not in debate is the fact that the front of her car hit the back of his.

    All I'm saying is that in his case, the driver changed her story & because there were no independant witnesses & because the insurance companies dragged it out so long, he eventually accepted a 50/50.

    Its worth bearing in mind that not everyone is completely honest when they cause an accident, & also that insurance companies are not always as proactive & dynamic as they might be.

    You have my sympathies. There's a lot of idiots like this about unfortunately. Exactly the same thing happened to me in April 2008 but not on a roundabout.

    A guy doing the school run (he was late) pulled out of a junction that I was passing and drove straight into the side of me, completely knackering my rear axle and suspension in the process. He was apparently distracted by his 3 children who were standing up in the car and was looking in the wrong direction as he pulled out and failed to notice my huge car directly in front of him!

    I took photos of my car, his car and him as I thought he might drive off without giving me his details. When he saw me taking photos he wrote his name and address down and threw the piece of paper at me saying that people like me (women) shouldn't be allowed on the roads and as far as he was concerned he'd done nothing wrong.

    The legal dept of my insurance company fought his insurance company until August of this year because he maintained that it was all my fault, even though it was clearly his. He stalled the case for as long as he could, saying that it was my fault for driving too slowly, my fault for not swerving out of his way, my fault for being a woman. He said he wasn't there at the time the crash happened (he changed his mind when reminded about the photos I took) and then said I was deliberately setting him up but couldn't provide a reason for me wanting to do so.

    His insurers finally gave in 17 months after the crash and paid my claim in full when my insurers told them that we were going to court and he could tell his lies to the judge.

    Good luck and be prepared for a long fight.

    I was involved in a roundabout accident. Don't assume that anything in the highway code will apply.

    My view: I entered the roundabout and was then held in queuing traffic on the roundabout. A car entering from the junction to the right of mine entered the roundabout without noticing that the traffic was queuing and hit my rear driver door and wheel arch.

    Other view: They entered the roundabout the junction before me (so with RoW) and I cut in front of them to enter the roundabout, then sharply braked causing them to go into my rear driver door.

    We went to court and I won. Both versions sounded plausible, but I had 10 years driving experience and was on a route I knew, they were a new driver and out on a spin. I think that was what swung the judge, together with me asking where their passanger was and why wasn't she a witness and them claiming there was no passenger - made them look to be lieing.
