offer what amounts to scrap value..which is all it will be worth to the OR.......I offered £70 for my second, old car, a real tat heap to look at, sound mechanically...fine for the OR!

Perhaps, with the 'carer' issue, the OR will consider what LA help is available, ie whether the individual is substituting for LA services, or whether it will be absolutely essential for the 12 month period?

[does Carer's Allowance come into it??]
No, I don't think all other drivers are idiots......but some are determined to change my mind.......

yep, usually if you are receiving carer's allowance a vehicle will be exempt as you are deemed to have this as a job, if you care for an elderly relative without carer's allowance it s harder to get it exempt

I'm not saying the car will be taken, just that it might and its better to be prepared.

    :j :j

  • What about if I stall it for say amonth and transfer my car over to my daughter? If the OR asks I could say I sold it to her to raise the fee?

If you sell it to your daughter at the going rate then, yes, you could use that money for the fees. You would need to show that she actually paid you for the car so there would need to be a bank transaction. Presumably she would let you have use of the car. That could get sticky though. Can you not raise £200 or so to buy it back from the OR if he doesn't allow you to keep it?

Thanks for your PM five year plan. What about if I reregister the car to someone else and not mention it to OR, will they check? I really cannot afford to loose my car, my kids would not get to school. Public transport is pretty infrequent and unreliable here.

I cannot raise any money, Its taken me ages to get £360 as I am currently not working due to a breakdown. Income support is barely enough to pay bills let alone save anything.

I think I am just going to have to cancel going and chicken out, I cant run the risk.

Many thanks for your help though.

part of your SOA for the court asks if you have recently sold [a car]? Attempting a cover-up which MAY come to light could result in more dire consequencies.

I would simply leave as is [try to be brutally honest about the car's value and condition], and put together a reasoned argument that the OR can be presented with for allowing you to keep it.

If that doesn't work, then ask if you can purchase the interest in it.

A 'P' reg car will attract but scrap value....ring around a few scrappies for an average price, then offer the OR that.

If the OR refuses the offer, they may suggest one of their own....I don't know if they're open to haggling...but I suspect the OR wont really have any interest in it..it will be a liability. Also, find out if the OR would be amenable to purchase of interest in stages??

I assume you're struggling to raise the BR fees?

Have you tried applying for relief?

  • If i was you i would say you sold the car to your daughter for the BR fees. it is not high value he wont take her to court to get the car back its value is not high enough value to.
Dont back out now, you have come this far. If your only income is benefits you may not have to pay a IPA.
  • Nervousmother, I dont want to back out, would rather face it out but I just cant run the risk of loosing car. I know that probably sounds pathetic to people but it really would cause me major grief, also, I want to get back to work as soon as I can, as soon as I can cope and I would need the car for my job. It is all such a mess.

Alastairq, you are quite right about me struggling to get fee. I got exemption form from court for £150 but as you know, I still have to pay £360. What is relief????
  • I knew someone who went BR was out of work but looking for a job, they got to keep the car on that basis as they lived 10mils from anywhere. Their car was worth about £400.
