PPI Lloyds - can I try again to reclaim?

    Mine is at FOS now against the insurer and mine is for unfair rebate although they say "you have to prove the rebate was unfair". I have said it was unfair cause in the terms and conditions of the policy it does not give an example of how the rebate is worked out and also states that if you cancel the loan PPi you will NOT get a rebate in proportion to the policy but rather under the use of the rule of 78. Total cost of policy including interest £9K and got £90 back after paying for 38 months. FOS are still in negotiations with the insurers apparently and they can only take misselling complaints to the insurer if the insurer was actually TIED to the lender/broker. This I am told is VERY difficult and requires a lot of laws to be bought in and they, the insurers, are fighting it all the way. I am fed of waiting for this and when I rang last week I was told again that they have no idea how long this complaint will be before I do hear if they can look into it or not....

    Its driving me crazy TBH. I just want to know but getting nowhere.

    This one have been a difficult one hasn't it Marshallka?
    What a drag its been for you.

    Will be a nice surprise if they can get this sorted in time for xmas for you or before.;)

    I have to look through all my paperwork on this again.

    I asked this week if they will be able to sort in time for Christmas and they still said they had no idea. Just have to wait my turn I suppose. I bet yours will be in and settled Di before mine gets near an adjudicator or even looked into to see if they can make a complaint of it. It is beginning to get me down though now. I think when dark nights are upon us everything seems worse.

    Not knowing is a right pain.
    I hope now that they have new adjudicators, they will move on with yours ASAP, I'm not surprised its getting you down, its been a long time already.
    Funny enough I was talking about these early dark nights earlier to someone and they said they felt the same,like we do at this time of year, surprisingly how common this is.
    With a win Marshallka that would be a great help now wouldn't it?

    With hubby he heard from the FOS a few days back and they said it will be at least a few weeks before they give the final decision, but can't grumble, its with the ombudsman, hope that will be the same decision as the adjudicator which lloyds completely ignored.

    I totally agree with everything that's been said here (by people who have helped alot of forum users). Three points (if I may...)

    1. In the origional post you say "my main reason was that I have a pre-existing medical condition which I did tell them about" ... does this mean that they asked you about existing medical conditions when the PPI was started? If they did, and you didn't disclose it then the chances are that you don't have a claim for mis-selling on that point. However, if you're saying that they didn't tell you that pre-existing medical conditions would not be covered, then I think you do have a claim for mis selling.

    There may be other/more reasons why you have a claim for the policy being mis sold - so check the list!

    2. If you go FIRST to the ombudsman, and the ombudsman can't help you (or even if the ombudsman doesn't back your complaint) - then you can still go to the county court. There are plenty of people who can help you do this (it's a bit more hassle admittedly - but it IS still an option).... The thing you can't do is go to the county court first and THEN try the ombudsman.

    3. You have six years from the point that you discovered that you had been mis-sold the PPI to lodge your complaint - so dont worry too much about the time limits.

    (my own PPI claim couldn't be dealt with by the FOS (although I tried!) so I'm going down the county court route... and although I have to admit that dealing with lawyers is about as pleasant (sic) as a fart in a spacesuit ... there ARE still ways to reclaim.... & Milly - you're more than welcome to "come and watch me perform" in Weston County Court when my case is heard ...)
