should i claim??

hi,
i bought i car on finance in 2004 was was told when i took it out that i had been declined finance with peugoet finance but could take it out with blackhorse as long as i bought payment protection insurance with it. is this miss selling???? i have since re financed in 2007 and that finance agreeement is up in feb 2010, this agreement also had payment protection added onto it. i wasnt aware that this had continued with this second agreement i took out.
if i am able to claim back who do i right to blackhorse themselves??? so i make a claim back to 2004 or just for the most recent finance agreement??
any advice would be great as any extra pennies to be gained would be amazing right now as am expecting twins in jan

    Hi Nonni,

    Go for it all, in my opinion this was mis sold from the start so go for it.

    You write to the ones who arranged and sold you the finance, by giving your reasons as you have stated above, and also in the link below you will find a checklist of mis selling reasons, if they also apply to you then write them as well.

    Remember to write the 2 account numbers on the one letter, and do not worry about writing the amounts.

    You will also find templates on the link below, but you do not have to use them if you don't want to, but just as a guide, its up to you, and they have 8 weeks to respond in full.

    Keep at them until they resolve in your favour or until they issue you with the final response, they should enclose if eligible the details of the financial ombudsman service (FOS), where you can take your complaint to them if your not happy with the outcome.

    Best to post by recorded delivery as well, this is your proof of posting.

    In a nutshell, yes.

    It was never mandatory to have it and being forced to take it against your will when there was no need to is a mis-sale.
