More ebay problems 
On the 29th i won two auctions from the same seller for some CD's, i paid instantly with Paypal and got a swift response saying they would send both CD's together and cut the postage costs. So far so good!
After this i heard nothing until i emailed the seller a week later to enquire where my CD's were, he responded to say he posted them earlier that day (Friday) and should be with me soon. Nothing arrived on saturday monday or tuesday so when nothing arrived on Wednesday i chased him again. This time he said that he had been in contact with the post office and they have confirmed there was a problem at his sorting office.
We are now at friday and nothing has arrived. I only bought the CD's as they were very cheap and a last minute impulse ebay purchase. The seller has said that he will only refund me when he gets confirmation from the Post Office that they have been lost in the post and then he will only refund the cost of the CD's (£0.01 and £1.23).
Now seeing as i paid by paypal should i just do a chargeback as goods not arrived? The chap seems genuine (100 feedback at 100%) and has left positive feedback but i'm just cheesed off with things.

yes, i think you should do a chargeback. Why should you lose out on the postage charges. Seller taking advantage i think.

He might seem genuine but obviously isn't if he won't refund your p+p cost. I'd do a paypal chargeback for goods not received and I'd neg him too, or neutral at the least, to warn other that he doesn't refund p+p costs. Also if he waits for confirmation from RM, which could take 2-3 weeks, then decides not to refund you it may be too late for you to do the chargeback by then, I think you have 45 days.:heart2: Love isn't finding someone you can live with. I've been waiting for two weeks for my item to arrive. Seller says he has posted it and for me to be patient. I didnt pay with paypal, I sent a postal order. Do I have any chance of getting my money back? I've kept the counterfoil and I made it out to his name. The item cost £15 plus £5 special delivery postage. Should he refund the entire sum?0

After 14 days from postage the seller will be able to claim all costs from the Royal Mail, and so they cannot complain about giving you a refund. The sellers duties are to you, it is not Royal Mail's duty to ensure you get a refund, they're responsible to the seller only in this case.
Personally I would start a chargeback immediately and then try a non-performing seller.Stuff Happens As Wave of Ambiguity Spreads:cool:0 -

You have very little protection as you did not use paypal. Your only claim would be an ebay one that will cost you £15 and does not cover the post and packing element of the cost. (Paypal claims are different as they do refund post and packing).
Unfortunately there is very little you can do except to ask the Post Office if the postal order has been cashed, and of not put a stop on it.

Well i've filed a claim with paypal so will have to see what happens although i presume that as they were only sent normal 1st class he won't be able to provide a tracking number so should lose the claim.0

Yep, if he can't prove delivery then he will lose the paypal chargeback.
