Advice council demanding money.

In 2005 i had a council flat which i handed back to the council and thought that was it. in 2007 i had a bill from council for £2.793.78 for overpayment of housing benefit.
i appealed the bill and won the case (as the council had lost the keys of the flat) the letter i had from the appeals panel was the ammont of £2.674.93 has been removed from my account and i have taken the steps to remove the sum of £119.15 from your account. which means all the ammount should have been gone and the account clear.
I applied for a new council property this year and was made to pay £180 for the water rates of the last flat before my application would even be accepted.and now i am still getting letters threatening me with court action for the sum of £119.15 which should not be on my account.
Can i take the council on for demanding money as the stress they are causing to me and my partner who who is expexting in 3 weeks is making her and myself ill.:mad::mad:

  • I don't think you can take them on for stress caused but just give them a ring with a note of the court case date/number and remind them that the account is clear, that they have made an error and ask them to confirm that your account is now clear, in writing.
  • They have had 5 copies of the letter showing the money should be off the account even from the local MP but they are still demanding the money. this has been going on no for 10 months.
  • I don't understand why you have had to send them copies of a letter they sent to you in the first place - do they not have this information on your file or have they lost it?

  • I would personally take a copy of the letter into the council offices and demand that the matter is sorted out there and then. Also, I'd ask for a receipt for the copy of the letter so they can't say they haven't had it. But, don't let them have the original - make sure you keep that for yourself.

    Have you thought about contacting citizens advice (you may have already done that)?

    My sister had a problem with the Council recently. She kept getting threatening letters and phone calls about money she didn't owe. It went as far as going to court and once in court they said 'Oh that's our mistake' end of matter. So if you've got evidence that you don't owe them anything then the next time they badger you just tell them to take you to court for them to sort it.
