Redundancy Question

If you are made redundant, and someone leaves the company in the same role as you had, are the company obliged or required to re-employ you within a certain amount of time, or once you have left is that it?

I was made redundant and a girl who I worked with has just left (and she was doing the same role) so I was wondering if theres any chance of me getting my old job back.

    And what makes you think that? Certainly wouldn't apply to statutory redundancy and given that the holiday pay would have been for holiday accrued but not taken during the period of employment then that couldn't be reclaimed by the company either.

    apologies, totally agree re the holiday pay.
  • Other posters are right, you don't have any automatic right to be offered the job, but you'll probably be an attractive candidate to the employer if you apply for it because they won't have to pay to train you again and you'll be able to jump right in and right up to speed.

    Regardless of the length of time between leaving and re-applying for another post (unless it's really short like maybe a week), you have no obligation to repay anything you were given as part of your redundancy settlement.
    Because you are not applying for your old job (that post was ended, this is a different post even if it's doing the same duties), any new employment is exactly that, new employment.
    The only down side is that you will have lost your length of service benefits, but that is part of the reason you were compensated when you were made redundant.
