Ill and in a tenancy agreement

Hi I wonder ing if anyone could help, I been in my flat 6 months soon and over last 4 weeks I had to leave work on sickness. After this month being on half pay meaning I wont be able to afford my rent.

My agreement is worded:

The landlord lets and the tenant takes (Address) with its fixtures and fittings for a term of 12 months comencing on 11.04.09 with 1 calendar notice each way and if the tenency is not provided at a rent of ££ per week.

I read this as being able to give a months notice to leave at any piont but I wondering if I am right.

    sorry - this means you have signed an agreement to pay the rent for 12 months from the 11 April 2009. If you want to leave earlier, and IF your landlord agrees, your lanldord is entitled ot claim his costs for replacing you as a tenant and he is entitled to take these costs out of your deposit.

    Can you claim housing benefit ?

  • I'm pretty certain that you cant be sacked for sickness, and that you'd be able to take them to an unfair dismissal tribunal...

  • hi sparkle83, you can loose your job for sickness it comes under capability to perform the role and you can also sack someone for failing to attend enough under performance aswell. without knowing the exact situation could not say if can take to tribunal depends on the processs the company has followed and the individual based on the companies terms.

    vegasbaby is right. If you are not capable of doing your job, you can be dismissed ... even if the reason for your incapability is sickness. All subject to "due process" of course, but generally, this just results in "death by a thousand cuts". But the outcome is the same - you can be dismissed if you are sick, provided your employer demonstrates that you are not capable of doing your job.

  • Hi yeah they can I am a relief worker and although this is my first sickness in over the yr i have wrked it makes money sense doesnt it. Hoe fully dics will sort me out and it mean only two months of ahhh instead.
