repair or replace

hi all
i brought a 42" 1080p lcd tv from argos 3 months ago it went wrong so they sent out an engineer who took it away
i had a phone call from argos saying it cant be repaired and they no longer do that model so cant be replaced
the only way i can get a same spec replacement is go with another make and pay the extra that it will be
i am really annoyed as i saved for a while and waited and waited to get the spec i wanted for the money i had now it seems i will have to acept a downgrade or pay out money which i havent got or a refund which will leave me without a tv untill prices come down
is there anything i can do

I would contact head office and explain the situation, I dont know where you stand legally but I would have thought that as it was only purchased 3 months ago and it was faulty then they should replace it at no extra charge to you. Good luck with it.0

Legally, Argos (or in fact any other retailer) is not obliged to replace your item with a higher value one.
It's all about economies of scale. So (I don't know how much you paid) let's say you purchased your TV for £449.99.
The options are:
(a) Repair
(b) Replace/exchange
(c) Refund
Under the Sale of Goods Act, the retailer is responsible to remedy the problem, however they get to choose which option is used.
So as it can't be repaired, option A is out.
As the model you had is no longer available (it was probably an R.O. item, meaning end of line and reduced price) and if Argos isn't willing to reduce the price of the next one up, then option B is out.
Only left with option C, a refund.
I can't remember the exact wording or section off the top of my head, but if you look up the Sale of Goods Act and there's a bit about repair/replacement being uneconomical etc it gives you the gist.
Sorry can't be much more help, you could try writing to head office, if you don't ask you don't get, but they may well say the same as I have.
