  • Little update, and some advice needed please

    We contacted a solicitor as were eligable for legal aid, who took the case over and has sent the finance company 2 letters, they have not repsonded to either.

    Today we have recieved a letter from the court, starting to get scary now, so we went to see the solicitor who is writing to them to advise the finance company have not responded, and also rejected the offer of token payments.

    Since I last posted I must say Lloyds have been very good, frozen the credit card interest, and are happy with £23 a month which is just about affordable.

    Can anyone please tell me what this court order is and why the finance company have gone straight to that stage?

    You would have to tell us more about the paperwork, not just a court order to be sure, as you can guess there are alot of different court orders.

    I would assume probably a CCJ (County Court Judgement, first port of call if you refuse to pay), if you are making offers of token payments and trying to pay them, that is all you can do.
    I guess you do not have a CCJ on this debt already?

    If they do attempt a CCJ the judge will only make you pay what you can afford, even if it is less than what you offered them. As you are attempting to pay and they are ignoring the legal letters there is no guarantee it would be approved, as it maybe seen as wasting the court time as you are trying but they are failing to respond.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

  • I believe it could be the CCJ, they had said whilst refusing over the phone to accept any kind of reasonable payments that they would get a charge on the house?

    I was hoping the fact they have ignored 2 letters from the solicitor it could stand us in good ground, also Lloyds have been great and accepted an affordable amount which we are happy with and paying each month.

    No there is no CCJ thing on the debt already

    I was offered 65 % on £9000 but declined because I didn't ask for a settlement and smelled a rat which proved true as the CCA was very Faulty!. Still fighting it though, was offered it again, twice in 3 months. I am now waiting to see what happens next,they have telephoned me a few days ago but I wouldn't speak to them. Sending the no phone contact letter tomorrow.
