So you fully admit that at no point did I tell the OP not to priovide details of THIER I&E! HER i&e includes MR's i&e... by refusing to give MR's details she is only giving half a story... Without MR's details she may as well make up the numbers from off the top of her head! The IVA will at no time implicate or include MR, his credit rating will not be notified and there will be no record of it anywhere. But for the sake of identifying HER EXPENDITURE, the IP may need to verify certain details of the HOUSEHOLD EXPENDITURE which may include MR. You said dont include MR and dont give his details, if the IP asks for those details then refusing them is the same as not giving the IP a new I&E. (Have i missed anything out?)
I'm only going to explain this once more (please do make this your limit), I HAVE DONE THIS AND EXPERIENCED IT FOR MYSELF!(excellent) When I moved in with my partner, I was asked to provide details of my new I&E together with proof i.e. letting agreement showing the rent. At no point did they ask for any details of my partners I&E.
So, by your reasoning, if the OP's partner refused to provide details of their I&E (after all, they are not obliged to!), the IVA would be failed due to a breach? I think not. Nice attempt at reductio ad absurdum :rolleyes:. If the IP believes you are not co-operating with the IVA then yes it can be failed.
EDIT: I would certainly welcome the detials of the experiences you've had to back up that what your saying is gospal. I work in insovency - experiences every day!
I'm not for a second saying that what I experienced is law and is 100% correct, I'm simply saying that in my experience (of one IVA) I have never (in all one times that i've been in an IVA) had to supply such details.
My partner and I broke up and I did a house share with a stranger, at which point in my IVA I did a renewed I&E to have my contributions adjusted. Again, my IP simply asked for confirmation of the rent, bills etc together with a completed I&E form, but from what your saying they should have asked for details of what this person's (who I'd never met before I moved in!) I&E was!? What would you do in their position, I know I wouldn't hand that kind of information over! You and your new housemate would not be expected to be sharing bills. Sharing the food bills and eating dinners together. Paying for eachother's phone/internet usage. In this case it would be acceptable to just presume that other communal bills would be split 50/50 - you're not going to be voluntarily paying for some stranger's bills!
The point I'm trying to make is that you don't HAVE to provide details of anyone elses I&E, I know because I've done it, twice! BUT you may be asked to provide various proofs when other people's I&E becomes intertwined with your own.Would you ask the wolves to look after the sheep?

But the Expenditure will be a joint expenditure...
They used my partners income to ofset agaisnt the total house hold out goings, so they could then go bacvk to the creditors with x amount surplus.0 -
so i dont need to tell my Ip about my new partner's finances? just mine? Sorry for all these silly questions. My new partner is quite not happy that I am in IVA. Will there be any restriction to her savings/money if ever? sorry again for these silly questions......:o
