HSBC PPI - Lost Documents

Hi All,
I'm hoping someone can advise. I wrote to HSBC 9th July with the 1st template letter asking for a copy of my loan documents to check the PPI. I finally received a reply dated 15th Sept (:eek:) stating that they couldn't find a copy of my original loan paperwork (loan taken out Sep 06) but it did include £2.5k of PPI. I need to write back to reclaim the PPI but how can they check if this is correct without the paperwork? Anyone got any views if I should just proceed as normal or kick up a fuss about lost paperwork?
Any thought's greatly appreciated.

When requesting for your documents, was this done by a Subject access Request (SAR)? where you pay £10 postal order or cheque payment, and they have 40 days to comply?
Or was it just a basic request for your paperwork?
If not an SAR, maybe this way would be a good idea with the SAR template here below:

Post by recorded delivery as well for your proof of posting.;)
Is this loan active or settled?
If settled they should be able to go back approx 6 years, on all the info they hold on you, if stiill active they are bound to still have your details and should have provided you with your agreement with a payment of £1 postal order or cheque payment, this only take 12 days for the agreement request with payment.;)The one and only "Dizzy Di"0 -

But have they said they have not got the agreement?? If this is the case then how can they send it within a SAR perhaps? Is the loan still active or not? Have they stated in writing they have not got the agreement?0 -
They have stated in writing that they haven't got a copy of the agreement and the loan is currently still active.

I assumed if the account is still active they should still hold this (your agreement) on their records, but maybe as Marshallka have said, if you request a SAR with a payment of £10 postal order or cheque payment, they should supply this, you never know it may just suddenly appear within the SAR.;)The one and only "Dizzy Di"0
