Hi my boyfriend over two years ago went to court over a drunken disorderly fine for £80.00-he had clear CCTV footage of the police attacking him, anyway it was thrown out of court and he was seen as an innocent man! He received all his legal money back.
However we were stopped in the same place in Kent a couple of weekends back and the police said he had a 'prior' of course my boyfriend stated that he was completely innocent, and htey said nothing.
I am completely confused as to whether he owuld need ot declare htis on employment applicaitons and whether it is correct htat the police hold this?
Any information will be greatly received

if he went to court and was found guily of the charge then he would have a conviction and would need to declare it on the application form as it is not spent under the reabilitation of offenders act - 5 years before it becomes spent
he was not found guilty so no he does not have to declare it unless the question on the application form asks specifically wether he has ever been arrested.
the police would hold record of his arrest on the pnc and that wont get taken off - unfair but that's how it goes0 -
I wonder if the police offers that attacked him are noted as having prior...
Try contacting the Data Protection Officer at Kent Police Head Quarters http://www.kent.police.uk/Freedom%20of%20Information/Data%20Protection/Data%20Protection.html They will advise you of how they note any information, whether you have to declare it and if there is a mistake on their computer they might be able to correct it.0
