I have told her I am handing official notice in to the landlord on 30th Sep
...
Am I right in thinking, as long as I have paid my share up to the end of October, I can move out at any time before then?
You said your agreement was until the middle of next month, the rent date is usually the decider for when you're liable to pay up to.
Once you have stayed beyond the day before your rent date, you'd then be liable for another full month's rent. So you need to check this with your landlord. It is most likely that you really need to inform the landlord you are leaving in the middle of next month (day before rent date), the day that your AST ends.
So then it gets complex. Stay one day longer and both of you are liable for the whole month's rent (to the middle of the following month), BUT, then you're on a periodic tenancy, so to even leave in the middle of November you'd need to have given notice on/before the mid-October rent date.
You need to sort out your dates and what you are doing and make sure you understand your obligations.
You could tell your LL you are leaving in mid-October, then your flatmate will have to get a new agreement (on their own) going with the LL and you can simply stay on for 2 weeks as the lodger (or something) ... but there are legal obligations and expectations that could come back and bite you, so check the situation out.0 -
