Can I buy iPhone 3g(s) without contract

I want to buy my husband either an iPhone 3g or iPhone 3gs for his birthday. My question is, can I still buy it from apple without a contract, he has the original iPhone and we got that from apple, obviously it had to be unlocked, I need to order soon, can anyone help. The reason I am asking is that I have read that they are clamping down on people buying them and not going with o2, I don't know how true this is.

Which network do you wish to have access to? If it is Orange (and possibly T-Mobile), I believe the Apple iPhone 3G will be coming as soon as October.
You can however, as BargainGalore has suggested to purchase the phone directly from O2 then 'jailbreak' the iPhone. As you have correctly stated, Apple are fighting hard against 'jailbreaking' iPhones. That being said, it is still possible and is not that difficult. I wouldn't however recommend this as it breaches their Terms and Conditions.

Please note this is currently not available due to apple removing 3.0 firmware as a roll back. The only firmware available is 3.1 from iTunes which cant be jailbroken yet as the Dev Team hasn't released it.
Only way to get a jailbroken handset is a second hand one from flea bay already done0 -
In France the law does not allow companies to tie you into a contract when purchasing a phone so might be worth looking there.0
