Hi,

I sent off my SAR to MBNA and have now received info back. One of the reasons I did this was because I called them a while back and they confirmed that I had taken out 3 loans with them. For one of these I had the paperwork so submitted my claim (it was a front loaded PPI loan). They have rejected my claim so it's with the FOS now. Anyway, info arrives today and there is reference to another loan, which was also a single premium. Great!

However, re both the 2nd loan and the loan in dispute: NADA! I need to follow up with a letter stating that the SAR info is incomplete and somewhat remiss that re the loan in dispute, there is no info at all. Obviously my aim is to get my hands on the 3rd loan details.

Is there a follow up letter for these circumstances?

    Relating to Section 7 of the Data Protection Act 1998.

    Dear Sir/Madam

    Account Number: xxxxxxxx

    You will be aware that on **/**/** (date you sent SAR) I sent you a Subject Access Request under the Data Protection Act 1998. This was sent recorded delivery and was delivered to you on **/**/** (date it was delivered to them) therefore on the **/**/** (date when 40 days expired) you should have provided me with all personal data relating to me as a data subject. You have failed to comply with my Data Protection Act Subject Access Request and therefore I have made an official complaint with the Information Commisioners Office and no doubt you will be hearing from them in due course.

    If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

    I trust this clarifies my position.
