Are you at the appeal stage or tribunal? CAB helped me through my tribunal.
If you ask directly for a tribunal, they do a second appeal automatically anyway. You have to get a specific form, which I got from the CAB, which you have to fill out with your reasons for appeal.
You ask for an oral hearing, so you can give your side. They are nerve wracking, and they will ask you a lot of questions. You can take someone for moral support, or if you don't want to do the tribunal, get a representative."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0 -
PLEASE don't say that at a tribunal!!!!!!!!!!!!!
your son is NOT eligible for an award of DLA if he has learning difficulties and ADHD......................
it is how those difficulties affect his ability to care for himself and his personal care needs that will determine whether your application is successful or not.
I suggest you seek immediate help with this, whether it be a tribunal OR an appeal - that way you can get your sons particular difficulties across much better.
Remember you need to let the DWP/Truibunal know WHY he needs helps with personal care and exactly HOW you help him with his person al care
so for example, if he needs constant encouragement to wash and dress appropriately for the weather, you need to explain that and you need to tell them just how his disability affects him - it is long winded, but without proper explanations they simply can't allow the claim

Make sure you get help with your tribunal, gather as much information/reports together as you can. I had to go to tribunal in March for my daughter I had my local Law Center help me, as although I know very well how her disabilities effect her putting it in a way which DLA will then accept that her needs do meet the criteria is another matter.
I'm not sure how old you son is my DD is 13 and I got a letter from her headmaster explaining how she is functioning compared to a 13 year old mainstream child. He used what SAT levels a 13 year old should be achieving then gave my DD levels she came out as a 4/5 year old. He also then explained that even though she is able to follow some verbal and written instructions, she doesn't have the ability to put these in 'Real life' situations.
I found that by going to the oral hearing I was able to give a clearer picture of how her disabilities effect her daily life.
Good luck x" I would not change you for the world, but I would change the world for you"
