Can I buy Restrictive Covenant Policy myself/

I am buying a house, and the solicitor is recommending a indemnity policy (restrictive covenant). In addition to the premium, they want to charge an extra £40 to arrange the policy.

Are there any providers where I can take the policy out myself.

In short, no. It can only be purchased by a solicitor, but I have never been charged by a solicitor for the arrangement of such policies!

Normally you would expect the seller to pay for such a policy and so the seller's solicitor could arrange it and save OP paying his solicitor to do this. So OP should point out to his solicitor that the seller should pay for it. Maybe enlist the estate agents to persuade the seller he is being unreasonable if he won't pay.

I don't charge for arranging such policies, but I do know some solicitors, particularly those who quote very low basic fees, who do this.

As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
  • Its a repo, and the bank will not entertain paying for any indemnity.

The RC prevents parking on the drive. I beleive that the restriction may have been removed, as it was a standard condition on all ex local authority houses in the area - now most have drives!
